Summary

The module examines the basic principles of the law of tort, and examines specific torts in detail. The module will provide students with an extensive understanding of negligence. It will explore the duty of care, breach of duty and causation, and consider special cases, including liability for omissions, liability for injury caused by shock and liability for pure economic loss. It will also provide students with a detailed knowledge of trespass to the person, occupiers’ liability and nuisance.

Only available to UG Year 1 and year 2 students on the BA (Hons) programmes in the School of Law and exchange students hosted by the School of Law

Educational Aims

This module aims to allow students to begin to develop an understanding of the torts of negligence, trespass to the person, nuisance, occupiers’ liability and, through that, of general principles of the law of tort. It will introduce students to techniques of analysing legal problems and allow students to analyse legal principles and apply them to new factual situations.

Learning Outcomes

By the end of the module students should be able to:

1. Understand the key principles of the law of tort.

2. Describe and explain the key principles of the law of negligence, nuisance, trespass to the person and occupiers’ liability.

3. Explain and utilise common law reasoning to explain the application of the law of negligence in novel areas.

4. Interpret and apply the principles of law in the areas studied to new factual situations.

5. Analyse the law in the areas studied.

6. Evaluate the appropriateness and fairness of the law in the areas examined.
